Last updated: November 3, 2026Language:EspañolEnglish

This English version is provided for convenience. If it differs from the Spanish version, the Spanish version prevails.

1. Service provider

Callspace is provided by Crossmedia Software SL, tax ID (CIF) B72817661, with registered address at Avenida Finisterre 275, 2º IZ, 15008 A Coruña, Spain ("Callspace", "we"). Our full company details are in the Legal Notice.

2. Acceptance of the Terms

By creating an account or using the Callspace services, you agree to be bound by these Terms of Service and by the Acceptable Use Policy, which forms part of them. If you act on behalf of an organisation, you confirm that you are authorised to bind it to these Terms. Callspace is a service for businesses and professionals.

3. Description of the service

Callspace is a cloud business communications platform that lets teams manage inbound and outbound calls, call queues, recordings, intelligent routing and real-time analytics, together with WhatsApp Business conversations, AI voice agents and, through the email marketing module, contact lists, newsletters and email campaigns. The service is provided through the web browser and through the Callspace desktop and mobile applications.

4. Account registration

  • You must provide accurate and up-to-date information when you register.
  • You are responsible for keeping your login credentials confidential.
  • You must notify us immediately of any unauthorised use of your account.
  • You may not share your account with third parties or create accounts with false information.

5. Acceptable use

You agree not to use Callspace to:

  • Make unsolicited automated calls (telephone spam) or send unsolicited commercial communications by any channel.
  • Carry out illegal or fraudulent activities, or activities that infringe the rights of third parties.
  • Attempt to access systems, data or accounts without authorisation.
  • Deliberately overload the platform's infrastructure.
  • Resell the service without our prior written authorisation.

The Acceptable Use Policy sets out these obligations in detail for every module of the service. We reserve the right to suspend or cancel accounts that breach these conditions.

6. Plans and payments

  • Callspace offers different subscription plans. The prices and features of each plan are available on our website.
  • Payments are processed on a recurring basis (monthly or annually) through secure payment providers.
  • You can cancel your subscription at any time. The cancellation takes effect at the end of the current billing period.
  • We reserve the right to change prices with at least 30 days' notice.

7. Intellectual property

All intellectual property rights in the platform, including the software, the brand, the design and the documentation, belong to Crossmedia Software SL. You are granted a limited, non-exclusive, non-transferable and revocable licence to use the service in accordance with these Terms.

The data and content you upload to the platform remain your property. You grant us a limited licence to process and store them solely to provide the service to you.

8. Email marketing module

  • The email marketing module lets you send newsletters and campaigns to your own contacts. It is enabled for a workspace only after Callspace has reviewed it, and Callspace may decline to enable it.
  • You may only send from domains that you own or are authorised to use, and that you have verified in Callspace through the DNS records we provide (DKIM, MAIL FROM and DMARC).
  • Every marketing email includes an unsubscribe link and one-click unsubscribe headers, which you may not remove or disable.
  • Sending is subject to the limits that Callspace sets for each workspace, as described on the Email Compliance page. Callspace sets and adjusts these limits at its discretion to protect recipients and the platform.
  • The first campaign of each workspace, and campaigns of restricted workspaces, are reviewed by Callspace before they are sent.

9. Recipients, data sources and legal basis

  • You are solely responsible for the recipients of your communications, for the source of your contact data and for having a valid legal basis for each communication: prior consent, or another basis allowed by law, such as the existing-customer exception of Article 21.2 of Spanish Law 34/2002 (LSSI).
  • Before each import you must declare where the contacts come from and confirm that you have a legal basis to contact them. You must not upload purchased, rented, shared or scraped lists, or data obtained from any unlawful source.
  • You must keep evidence of consent and provide it to Callspace on request.
  • You must identify yourself accurately as the sender and make the commercial nature of your communications clear, as required by Article 20 of the LSSI and by the law of the recipient.

10. Unsubscribes and suppression lists

  • Unsubscribes made through Callspace take effect immediately for all marketing emails from your workspace.
  • Opt-out requests that you receive through other channels must be recorded in Callspace without undue delay.
  • Addresses that unsubscribe, complain or bounce permanently are added to your workspace's suppression list. You may not remove complaints or permanent bounces from it, nor reactivate suppressed contacts through an import or an edit.

11. Anti-spam compliance and sending limits

You must comply with applicable anti-spam and electronic communications law and with the Acceptable Use Policy. Callspace monitors the bounce and complaint rates of each workspace and may automatically pause campaigns, lower limits, or restrict or suspend email sending when they exceed the thresholds published on the Email Compliance page, or when there are other signs of abuse.

12. Personal data protection

  • Callspace processes the personal data of its customers' users as controller, as described in the Privacy Policy.
  • For the personal data of your contacts, call participants and recipients, you are the controller and Callspace acts as processor under Article 28 of the GDPR. Callspace processes that data only on your documented instructions and to provide the service.
  • You must inform the people whose data you process and handle their data protection requests. Callspace will assist you in doing so as required by Article 28 of the GDPR.
  • Callspace does not use your contacts' data for its own purposes and does not sell or disclose it to third parties, except to the infrastructure providers needed to provide the service.

13. Infrastructure providers

Callspace relies on specialised third-party providers to deliver the service, including telecommunications carriers for numbers and calls, the Meta WhatsApp Business Platform for WhatsApp messaging, payment providers, artificial intelligence providers for AI agents, and Amazon Web Services, through Amazon Simple Email Service (Amazon SES), to deliver email. These providers apply their own acceptable use rules; a breach of those rules caused by your use of the service is also a breach of these Terms.

14. Service availability and limitations

We strive to maintain 99.9% availability. However, we do not guarantee that the service will be uninterrupted. We may carry out scheduled maintenance, which we will announce with reasonable notice. We are not responsible for interruptions caused by events beyond our control.

Email delivery depends on recipients' mailbox providers, which decide independently whether to accept, filter or reject messages. Callspace does not guarantee that messages will be delivered, placed in the inbox, opened or read, nor that sending will not be delayed by the limits described in these Terms.

15. Limitation of liability

To the maximum extent permitted by law, Callspace is not liable for indirect, incidental, special or consequential damages arising from the use of, or inability to use, the service. Our total cumulative liability will not exceed the amount paid by the customer in the 12 months before the event that gave rise to the claim.

You will hold Callspace harmless from third-party claims, penalties imposed by authorities and costs arising from your contact lists, the content of your communications, or a breach of these Terms or of the Acceptable Use Policy.

16. Suspension and termination

You can cancel your account at any time from the platform settings. We reserve the right to suspend or close accounts that breach these Terms, with prior notice except in urgent cases or cases of serious breach.

Signs of spam, phishing, use of unlawfully obtained data, bounce or complaint rates above the published thresholds, or a notice from an infrastructure provider are urgent cases. In those cases Callspace may immediately pause campaigns or suspend email sending, outbound calling or the whole account as a preventive measure while it investigates. We will tell you the reason for the measure and give you the opportunity to respond. Serious or repeated breaches may lead to the termination of the account.

17. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice on the platform at least 15 days in advance. Continued use of the service after the effective date constitutes acceptance of the new Terms.

18. Governing law

These Terms are governed by Spanish law. Any dispute will be submitted to the courts of Madrid, unless applicable law provides for a different jurisdiction.
